Italy gives OpenAI initial to-do list for lifting ChatGPT suspension order

Last month Italy placed a temporary ban on OpenAI’s ChatGPT across the country due to a violation of data privacy and security ordering the company to stop processing local data. Now there have been reports that Italy’s Data protection watchdog has provided a to-do list for OpenAI’s ChatGPT that can help lift the suspension order on the AI chatbot.

Some of the demands initiated by Garante include justification for processing and collecting user data, placing a verification measure to restrict minors from accessing the AI chatbot, and more.

  • Italian Data protection watchdogs have provided a list of regulations and demands to OpenAI, which needs to be fulfilled by the end of the month to uplift the ban on their AI chatbot ChatGPT. 
  • It was reported by Garante they will keep investigating the data protection breach until then to reserve the right to impose any other methods required by the end of the probe. 

On Wednesday, Garante stated their set of “concrete” demands, which need to be met by OpenAI by 30 April. 

It was stated, “Only if the demands are fulfilled, then the restrictions placed on OpenAI chatbot ChatGPT will be lifted by the authorities concerning the use of Italian user’s personal data and 

ChatGPT will be made available for use again in the country.” 

On Thursday, OpenAI welcomed the agency’s moves. A spokesperson from OpenAI stated, “We are happy with Garante’s reconsideration of their decision, and we are looking towards making ChatGPT available to Italian users again soon.”  

Many experts believe the new regulations are extremely crucial for AI, especially due to its impact on national security, education, and jobs. 

The to-do list for OpenAI 

The regulator’s new compliance demands are as follows: 

The authorities asked OpenAI to publish information regarding the details of its data processing, 

ChatGPT needs to enable age gating to prevent users below the age of 13 from accessing the AI chatbot and move towards a robust age verification process. 

Justification on claiming user’s data for processing and training in its AI and generating ways for users and non-users to exercise their rights over their personal data. Including asking for corrections of inaccurate information created about them by ChatGPT (or the data must be deleted). 

Capability to object to the processing of data by OpenIA for training its algorithms, it should even conduct a campaign to generate awareness towards informing Italians of the processing of their information for training purposes of AI. 

Garante also stated they would keep on investigating the breaches of data protection rules and regulations by OpenAI and reserve the right to set any other procedures or actions required by the end of its investigation.

The ban initiated by an Italian watchdog across the country piqued the interest of other watchdogs around Europe. Who is also looking into the required measure for the chatbot? 

Apparently, the data protection agency of Spain has also requested the European Union’s privacy watchdog to estimate the concerns regarding personal data privacy and measures around OpenAI’s ChatGPT. 

Italy was the first ever Western country to place a ban on OpenAI’s ChatGPT. Before placing a ban on ChatGPT, the Italian regulator had also banned another AI chatbot, Replika in February, concerning Italian users’ personal data and citing risks to minors.
